1. Agreement to Terms

By downloading, installing, or using the CAIPHER mobile application ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Eligibility

By using the Service, you represent and warrant that you meet the minimum age requirements of the third-party platforms whose content you access through the Service. If you are not of legal age to enter into a binding agreement in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms and is responsible for your use of the Service.

3. Description of Service

CAIPHER analyses social media content accessible to the user and returns AI-generated knowledge including summaries, credibility assessments, verified claims, and relevant product recommendations. The Service does not permanently store, redistribute, or publicly display any original media content.

4. Third-Party Platforms

• The Service may allow you to optionally link third-party accounts to enhance functionality. You are solely responsible for your use of any third-party platform and for compliance with that platform's terms.
• The Company is not affiliated with, endorsed by, or officially connected with any third-party platform.
• The Company is not liable for any action taken by any third-party platform against your account arising from your use of the Service.

5. Content Processing

When you submit content for analysis, the Service processes the associated media temporarily. Media is not retained after processing is complete. All outputs generated by the Service are original AI-generated analytical works.

6. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at team@caipher.app if you suspect unauthorised access.

7. Free Tier and Pro Subscription

The Service is offered on a freemium basis. Free tier users are subject to processing limits and restricted feature access. Pro subscribers receive expanded access and capabilities.

Subscriptions are managed through Google Play Billing. Cancellations take effect at the end of the current billing period. Refund policies are governed by Google Play's terms.

8. Affiliate Disclosure

CAIPHER participates in affiliate marketing programmes. We may earn a commission when you make purchases through product links displayed in the App. This does not affect the price you pay. All affiliate links are clearly labelled within the App.

9. Intellectual Property

All content, branding, and software produced by CAIPHER are the property of the Company. AI-generated outputs are provided for your personal use under the licence granted herein. Users receive a non-exclusive, non-transferable, revocable licence for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from any part of the Service without prior written consent.

10. Prohibited Use

You agree not to:

• Use the Service to process private or restricted content you do not have authorisation to access
• Attempt to reverse-engineer, decompile, or access the Service through unauthorised means
• Use automated scripts, bots, or crawlers to access the Service
• Use the Service for any unlawful purpose
• Circumvent any rate limits or access controls of the Service
• Create competing products or services using information obtained from the Service

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Credibility scores are AI-generated probability assessments and do not constitute professional medical, financial, or legal advice. Always apply independent judgement before acting on information derived from any content.

12. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, account actions by third-party platforms, or reliance on AI-generated assessments.

13. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately.

15. Governing Law

These Terms are governed by the laws of India. Any disputes shall first be resolved through binding arbitration in Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator, prior to seeking court jurisdiction.

16. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of material changes via push notification or email prior to the change becoming effective. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and the Company regarding the Service.

19. Compliance with Indian Law

The Service is designed to comply with applicable Indian law. Users have the right to access, correct, and request deletion of their personal data by contacting us at team@caipher.app.
